Terms of Service
The rules for using PhotoFresco — the free editor, accounts, the ad-free subscription, AI credits, your content, AI agents and our responsibilities to each other.
Effective October 9, 2026.
These terms are an agreement between you and PhotoFresco. They cover photofresco.com, the editor, accounts, paid plans, AI features, cloud drive and the PhotoFresco connector for AI agents (together, "PhotoFresco"). Our Privacy page explains what we collect and is part of how we run the service, so please read it too.
Who we are
PhotoFresco is run by Josh Wardini in Portland, Oregon, United States. "We", "us" and "our" mean PhotoFresco. You can reach us at [email protected] or through the contact page.
Accepting these terms
By using PhotoFresco you agree to these terms. If you create an account or buy something, you also confirm that you agreed to them at that point. If you don't agree, please don't use PhotoFresco.
We may update these terms as the product changes. When we do, we change the date at the top of this page. If a change materially affects paid plans or your rights, we will also give notice before it takes effect, for example in the editor or by email to account holders. Continuing to use PhotoFresco after a change takes effect means you accept the new terms. If you don't, you can stop using PhotoFresco and cancel any subscription as described below.
The free editor
Editing is free and does not need an account. Opening, editing, saving and exporting run in your browser on your own device. Ads pay for this: the editor shows an ad (a panel beside the canvas on larger screens, a strip on phones), which can be served by Google AdSense or be our own "Advertise here" placement.
Free does not mean unlimited. Your device, browser and the size limits in Open files decide what you can work on.
Accounts
You need an account for AI features, cloud drive and purchases. When you sign up:
- Give an email address you control, and keep your password private. You are responsible for what happens through your account.
- Tell us at [email protected] if you think someone else is using your account.
- One account is for one person. Don't share it or sell it.
Paid plans
Ad-free subscription
Ad-free is a monthly subscription that removes the editor's ads and includes cloud drive. The price is shown in the editor before you buy.
- It renews automatically every month and charges your payment method until you cancel.
- Cancel anytime from your account panel in the editor. Canceling turns off auto-renewal; ad-free and cloud drive stay on until the end of the period you already paid for, and nothing more is charged.
- If a renewal payment fails, your plan stays on through a grace period while you fix the payment. If it isn't fixed, the plan ends.
- When the plan ends, ads come back and cloud drive becomes read-only: you can still list, download and delete the files you stored, but you can't save new ones until you subscribe again. Local editing never needs a plan.
Payments and refunds
Purchases are processed by Stripe on its hosted checkout page; we do not see or store your full card number. Prices are shown in US dollars. We may change prices for future billing periods; if the subscription price changes, we will tell you before the new price applies, and you can cancel before then.
Payments are non-refundable, including for partly used subscription periods, except where we say otherwise in the product or where the law requires a refund. Canceling stops future charges; it does not refund the current period. If you think you were charged by mistake, email [email protected].
Paid features are switched on as they become available, so some of what this section describes may not be offered yet. These terms apply to each paid feature from the moment you can buy it.
AI features and credits
AI features, such as image generation, background removal and AI Layer Split, run on server GPUs and are paid for with credits, when they are available. AI features are currently unavailable on photofresco.com.
- Credits are bought in one-time packs. They are not a subscription, and there is no free allowance.
- The credit cost is shown before you run an AI feature. If you don't have enough credits, the request is refused rather than charged.
- If an AI request fails on our side or the model provider's, the credits it used are returned to your balance automatically.
- Credits are for use in PhotoFresco only. They have no cash value and can't be transferred, resold or exchanged for money.
- AI work that has already been sent to the model provider is charged even if you or an agent stop it afterwards.
AI results are produced by third-party models and can be wrong, unexpected or similar to what others receive. Review them before you rely on them or publish them.
Your content
You keep all rights to the images, documents, prompts and other content you bring to PhotoFresco, and to what you make with it. We don't claim ownership of your content or of AI results generated for you, as far as the law gives you rights in them.
Most of your work never leaves your device. When you choose to send content to us, for example by saving to cloud drive, running an AI feature, sending feedback, or editing while session recording is on, you give us permission to store, copy, process and transmit that content only as needed to provide those features to you, to keep PhotoFresco secure, and to improve it as the Privacy page describes. For AI features, this includes sending your prompt and images to the model provider that runs the request. This permission ends when the content is deleted, except for copies we must keep by law or that remain in backups for a limited time.
You are responsible for your content. Only upload, edit or generate content you have the right to use, and make sure your use of AI results respects other people's rights.
If you send us feedback or ideas, we may use them without owing you anything.
Session recording and privacy
Session recording & diagnostics is on by default in the editor. While it is on, it sends us information about how you use the editor, and it can include copies of images you open. You can turn it off in Data & privacy, and it starts off in windows opened by the PhotoFresco connector. The Privacy page explains exactly what is collected, how ads use your data, and how to ask us to access or delete it.
AI agents and the PhotoFresco connector
You can let an AI agent, such as Claude Code or Codex, use PhotoFresco through the PhotoFresco connector, its MCP server or the photofresco command line. Use PhotoFresco with AI agents explains how this works.
- You decide whether an agent connects. Nothing connects until you check the connection code and click Allow, and a new agent session starts with no permissions.
- You decide what it may do. You grant permissions such as reading, editing, exporting, sending data to PhotoFresco services and spending credits up to a budget you set. You can pause or stop an agent at any time.
- An agent acts on your instructions. Treat what an agent does with your permissions as something you did. You are responsible for the instructions you give it and for checking its results.
- The agent's provider has its own terms. Anything you let an agent read is handled by that agent and its provider under their terms and policies, not ours.
- The connector has its own license. The connector, MCP server, command line and agent skill are open source under the MIT License at github.com/photofresco/photofresco-agent. That license governs your use of that software. These terms govern the PhotoFresco service it connects to.
Acceptable use
Don't use PhotoFresco to:
- Break the law, or infringe anyone's copyright, trademark, privacy or other rights.
- Create or share sexual content involving minors, content that sexualizes real people without their consent, or images meant to deceive, harass, threaten or defame someone.
- Get around AI provider safety filters, our usage limits, credit checks, plan checks or other access controls.
- Attack, overload, scrape at scale, probe for vulnerabilities in, or reverse-engineer our servers, or access accounts or data that aren't yours.
- Upload malware, or use PhotoFresco to send spam.
- Resell or offer the PhotoFresco service, its AI features or your account access to others as your own service.
AI model providers have their own content rules, and requests that break them may be refused.
Third-party services
PhotoFresco relies on other companies to work, including Google (ads), Stripe (payments), AI model providers (AI features) and hosting, content-delivery and storage providers. Their services have their own terms and policies, and we are not responsible for their actions. Links to other websites are provided for convenience; we don't control them.
Changes and availability
PhotoFresco is under active development. We may add, change or remove features, change limits, or pause parts of the service, including AI features, at any time. We try to keep PhotoFresco available but don't promise it will always be available, fast or free of errors.
Keep your own copies of important work. The editor saves locally in your browser and lets you export files, but browser storage can be cleared and no service can promise it will never lose data.
Ending your use
You can stop using PhotoFresco at any time. To close your account and have your account data deleted, email [email protected] from the address on the account. Cancel any subscription first; download any cloud files you want to keep.
We may suspend or close an account, or block access, if you seriously or repeatedly break these terms, if the law requires it, or to protect other users or the service. Where it is reasonable and allowed, we will tell you why and give you a chance to download your cloud files.
Sections that by their nature should continue after your use ends, such as payments owed, your content, disclaimers, limitation of liability and governing law, continue to apply.
Disclaimers
PhotoFresco is provided "as is" and "as available". As far as the law allows, we disclaim all warranties, express or implied, including that PhotoFresco is merchantable, fit for a particular purpose, accurate or non-infringing, and that AI results are accurate, unique or safe to use.
Limitation of liability
As far as the law allows, PhotoFresco and Josh Wardini are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or work, arising from your use of PhotoFresco. Our total liability for any claim relating to PhotoFresco is limited to the greater of the amount you paid us in the 12 months before the claim and US$50.
Some places don't allow these disclaimers or limits. Where that is the case, they apply only as far as the law allows. Nothing in these terms limits rights you have under consumer protection laws that can't be waived by contract.
Governing law
These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law rules. Any dispute that we can't resolve by talking it through will be decided in the state or federal courts located in Oregon, and you and we agree to their jurisdiction. If you are a consumer living outside the United States, you may also have the right to bring a claim in your local courts under your local law.
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part of these terms, we haven't given up the right to do so later. These terms and the Privacy page are the whole agreement between you and us about PhotoFresco.
